1. Scope and agreement

Sendiro is a platform for managing contacts, preparing marketing campaigns and sending transactional messages. Its operator works from Costa Rica; identification details appear on the Contact page. The person or entity entering the agreement is the customer. Anyone acting for an organization must have authority to represent it.

These terms work alongside Acceptable use and anti-spam, Billing and cancellation and, for data processed on the customer’s behalf, the Data processing agreement. The Privacy policy explains processing carried out by Sendiro.

Entering an agreement requires express acceptance of the applicable terms through an enabled acceptance mechanism or a written agreement with the operator. Acceptance must identify the customer, their authority, the workspaces covered and the accepted version. Reading these pages does not constitute contractual acceptance. Particular conditions agreed in writing take precedence within their scope without reducing nonwaivable rights.

2. Accounts and workspaces

Provide accurate information, keep contact details current and protect your credentials and API keys. Do not share a personal account instead of assigning member permissions. The owner manages the workspace and must give people appropriate access and remove access when it is no longer needed.

You are responsible for instructions and operations of users you authorize, within the limits established by law. Notify support if you discover unauthorized access. Sendiro may request proportionate evidence of identity or authority before changing access or releasing information.

To assess or maintain sending access, Sendiro may request the organization’s activity and website, intended use, sample messages, volumes and frequency, and evidence of recipient provenance and permission. Provide truthful information and report material changes. Creating an account or obtaining capacity does not guarantee authorization for a use that violates the policies.

3. Availability and beta status

Sendiro is in beta. Features and limits depend on the environment and the workspace’s confirmed allocation. Real email requires sender or domain authorization, operational activation and available capacity. Adding a sender in a simulation does not enable real email. Amazon SES access and restrictions also affect sending.

A provider accepting a message does not guarantee delivery, inbox placement, an open or a response. Sendiro may apply limits and pauses to protect the service. It will communicate relevant incidents and material changes through the available channels. No guaranteed availability or service level applies unless separately agreed.

4. Content and recipients

You retain the rights you hold in your contacts, brands, designs and messages. You grant Sendiro only the permissions needed to host, process and transmit that content according to your instructions and provide the service. You must have the rights and permissions needed to upload and use it.

The customer chooses recipients, purposes and content. The customer must retain the permission evidence required by the anti-spam policy, identify the sender, honor unsubscribe requests and follow the rules applicable to its campaigns. An import, a purchase or an earlier business relationship does not by itself authorize advertising through Sendiro.

5. Plans and operations

Check the effective allocation of each product in your workspace. Prices and limits in an offer do not replace confirmation of the agreement. Billing currently operates in simulation or PayPal Sandbox; Live charges and tax invoicing are not enabled. Any real charge requires prior disclosure and acceptance of the total price, currency, applicable taxes, billing frequency and cancellation terms.

Additional capacity is not purchased automatically when usage exceeds a limit. Supported cancellations preserve access through the end of the confirmed period. Canceling a subscription does not delete an account or its data. Details and applicable conditions appear in Billing and cancellation.

6. Security and data processing

Each party must take reasonable measures within its area of responsibility. Customers must limit uploaded data to what is needed, protect integrations and avoid putting secrets or unnecessary information in templates, logs or support requests. The DPA covers instructions, assistance and providers processing customer data.

An unsubscribe or suppression may require retaining limited information to prevent inappropriate future messages. Archiving, cancellation and deletion have different effects. Request export or closure instructions before leaving the service; complete, immediate deletion of history or backups is not promised.

7. Restrictions and termination

Sendiro may restrict sending or access where there is reasonable evidence of abuse, a security compromise, a breach or a requirement from a provider or competent authority. Measures must relate to the risk and may take immediate effect if delay would increase it. Where possible and legally permitted, Sendiro will explain the reason and how to request a review.

To close a workspace, contact support from an authorized account. Resources, pending operations and available recovery or export options will be reviewed before closure. Termination does not remove recipient rights or obligations that must survive.

8. Responsibility, changes and disputes

Each party is responsible for its conduct under applicable law. These terms do not exclude liability that cannot lawfully be limited or nonwaivable rights of customers or data subjects.

Material changes will be communicated before they apply where required, with their scope, version and effective date. Where a change requires renewed acceptance, publication alone will not count as acceptance. Changes will not apply retroactively to remove acquired rights.

These terms are governed by Costa Rican law without displacing mandatory laws or applicable rights to approach competent authorities or courts. You may raise a dispute through the contact channel; doing so is not a condition for exercising those rights.
